(W-1937) The Struggle with HOAs is Real!

Description
In every state across the country there are a growing number of private organizations called homeowner's associations or HOAs. In some areas they are referred to as property owners' associations or POAs. In the United States there are an estimated 310,000 homeowners' associations. This accounts for 53% or 40 million households within the United States.

With an estimated population of 29 million people, Texas has its share of HOAs with unrealistic expectations and deeds for the landscape that lead to over use of water and chemicals in the landscape. This is why the state legislature stepped in and established both House and Senate Bills protecting property owners from the heavily restrictive landscape deeds that prevent them from practicing water efficiency in the landscape. Specifically, Texas Senate Bill #198 chapter 736 which went into effect in September of 2013. This bill restricts HOAs from restricting water efficient practices like composting, rainwater harvesting, drought tolerant landscaping, efficient irrigation and drought tolerant turf.

Listen and learn from the State of Texas' experiences with this bill, and the successes and the litigation that defined parameters we now follow. This bill has the possibility of being used as a template for other states helping aid your conservation programs within HOAs.

Here at Water University we aim to reduce the water and chemical footprint in the urban landscape, and it is laws like this that allow us to further our efforts with less resistance but that does not mean we have not felt resistance.
